✅ Acceptance of Terms

By downloading, installing, creating an account on, or using the MunchLog mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legally binding agreement between you and Nitzan Selwyn, trading as MunchLog, based in Israel ("we," "us," or "our").

These Terms apply however you obtained the App — the iOS App Store, Google Play, or otherwise. Please read them before using it.

You must be at least 13 years old to use MunchLog, or 16 if you are in the EEA or the UK. If you are using MunchLog on behalf of an organisation, you agree to these Terms on its behalf.

📱 Description of Service

MunchLog is a nutrition and wellness tracking application that lets you:

• Log meals by describing them in plain language, by typing or by voice dictation
• Receive AI-generated estimates of calorie and macronutrient content
• Log physical activity and receive an AI estimate of extra calories burned
• Track daily water intake
• Record and visualise weight trends over time
• Set and monitor personalised nutrition goals
• View meal history and weekly nutrition summaries
• Optionally connect Apple Health on iOS to read steps and active energy, and to write logged meals back to Health
• Set local reminders

MunchLog does not analyse food photographs. Meal logging is text and voice only.

We may modify, suspend, or discontinue any part of the App at any time. We will give reasonable notice of significant changes where we can.

🏥 Health & Medical Disclaimer

What MunchLog is NOT

• A substitute for professional medical advice, diagnosis, or treatment
• A clinically validated nutritional analysis tool
• A tool for managing eating disorders, diabetes, or any condition requiring precise nutritional tracking
• A licensed healthcare provider

Limitations of AI estimates

Our estimates are generated by a language model reading your text description. They:

• Are approximations and may differ substantially from actual nutritional values
• Cannot account for preparation method, exact portion size, added oils, or recipe variation
• May be less reliable for uncommon foods, mixed dishes, or regional cuisine
• Should not be used for medical nutrition therapy without professional verification

Always consult a qualified healthcare professional, registered dietitian, or nutritionist for medical nutrition advice — particularly if you have a health condition, are pregnant or breastfeeding, are under 18, or are managing a diet for medical reasons.

👤 Your Account

An account is required

MunchLog requires you to create an account. You can sign up with an email address and password, with Sign in with Apple, or with Google. Authentication is handled by our provider, Clerk.

Your responsibilities

• Provide accurate registration information and keep it current
• Keep your credentials and your device secure — you are responsible for activity under your account
• Tell us promptly at support@munchlog.net if you suspect unauthorised access
• Use one account per person, and don't share it or transfer it

Accuracy of what you enter

Your calorie targets are calculated from the age, height, weight, gender, activity level, and goal you enter. If that information is wrong, your targets will be wrong. You are responsible for the accuracy of what you put in.

☁️ Your Data

This means:

• Signing in on a new device restores your history
• Deleting the App does not delete your account or your data. To remove it, delete your account — see munchlog.net/delete-account
• We can access your stored data where necessary to operate, secure, and support the service, and where the law requires it
• Deleting an individual entry in the App removes it from our database

Exactly what we collect, who processes it, and how long we keep it is set out in our Privacy Policy, which forms part of these Terms.

Backups and data loss

We take reasonable measures to keep your data available, but we do not guarantee against loss. We are not liable for data lost through service interruption, your own deletions, account deletion, or a lost or damaged device. Deletion is permanent and we cannot restore a deleted account.

🤖 AI Estimates & Third-Party Processing

When you ask MunchLog to analyse a meal or an activity, the text you entered is sent to OpenAI, a third-party AI provider in the United States, which returns the estimate. For activity estimates we also send your body weight, because the calculation needs it.

By using the analyse feature you consent to that transfer. We do not send your name, email address, or account identifier with the request. Full detail is in the Privacy Policy.

Do not enter personal or sensitive details into the description field beyond what you ate or did — the text is sent as written.

Free-tier allowance

Free accounts include a limited number of AI estimates per calendar month. When the allowance is used up, further AI estimates require an active subscription until the allowance resets at the start of the next month. The current allowance is shown in the App.

Availability

The AI feature depends on a third-party service and an internet connection. It may be unavailable, slow, or return an error, and we do not guarantee uptime or response time.

🚦 Acceptable Use

You agree to use MunchLog only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable local, national, or international law
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Circumvent, or attempt to circumvent, the free-tier allowance, subscription checks, or any other access control
• Use automated scripts, bots, or tools to access the App or our backend, or to generate AI requests at volume
• Attempt to gain unauthorised access to any account, system, or network connected to the App
• Use the AI feature for anything other than estimating your own food and activity
• Upload or transmit viruses, malware, or other malicious code
• Impersonate any person or entity, or misrepresent your affiliation with one
• Use the App for any commercial purpose without our prior written consent

We may suspend or terminate accounts that breach this section.

©️ Intellectual Property

The MunchLog name, logo, app design, user interface, graphics, features, and all other content are owned by or licensed to MunchLog and are protected by copyright, trademark, and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial use.

Your content

You retain ownership of the content you create in MunchLog, including your meal and activity descriptions. You grant us a limited licence to store, process, and transmit that content solely to provide the App's features to you — for example, sending a meal description to our AI provider to generate an estimate, and saving the result to your account. We do not use your content to train AI models.

Feedback

If you submit feedback, ideas, or suggestions about MunchLog, you grant us a perpetual, royalty-free licence to use that feedback to improve our services, with no obligation to you.

💳 Subscriptions & Purchases

Free and paid tiers

MunchLog offers a free tier with a monthly AI-estimate allowance, and an optional paid subscription that removes that limit. What each tier includes, and the current price, are shown in the App before you buy.

Billing

Subscriptions are billed through the Apple App Store or Google Play on a recurring basis (monthly or annual, as selected). Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Payment is charged to your store account at confirmation of purchase and on each renewal.

Introductory offers and trials

Where an introductory offer or free trial is available, its exact terms, length, and your eligibility are determined by Apple or Google and are shown on the purchase screen before you confirm. Not every user is eligible for every offer. Unless you cancel at least 24 hours before a trial ends, it converts to a paid subscription at the standard price.

Cancellation

Cancel at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you keep access until then. We do not offer prorated refunds for unused time. Deleting the App or your MunchLog account does not cancel your subscription — cancel it with the store separately.

Refunds

All purchases are processed by Apple or Google, and refunds are handled by them under their own policies. For iOS, use reportaproblem.apple.com. For Android, use the Google Play refund process. Statutory withdrawal and refund rights in your country are unaffected.

Price changes

We may change subscription prices. We will notify you in advance as the stores require, and you can cancel before a new price takes effect.

⚠️ Disclaimers & Limitations of Liability

App provided "as is"

MunchLog is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Accuracy of AI estimates

We make no representation or warranty about the accuracy, reliability, completeness, or timeliness of AI-generated nutritional estimates. Actual nutritional content may differ significantly.

Limitation of liability

To the fullest extent permitted by applicable law, MunchLog shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or goodwill
• Health outcomes, weight changes, or dietary decisions based on App data
• Any damages arising from reliance on AI-generated nutritional estimates
• Service interruptions, bugs, errors, or unavailability, including of third-party services we depend on

Our total liability shall not exceed the greater of the amount you paid us in the twelve months preceding the claim, or USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law in your country.

Indemnification

You agree to indemnify and hold harmless MunchLog from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, your breach of these Terms, or your violation of any third-party rights.

🚪 Termination & Deletion

You may stop using MunchLog at any time. To remove your data as well, delete your account — see munchlog.net/delete-account. Deleting the App on its own leaves your account and data in place.

Remember to cancel any active subscription through the App Store or Google Play. Deleting your account does not cancel it and does not entitle you to a refund for the remainder of a paid period.

We may restrict, suspend, or terminate access if we determine, acting reasonably, that you have breached these Terms or engaged in conduct harmful to MunchLog, our users, or third parties. Where practical we will tell you why and give you a chance to respond, except where we are legally prevented from doing so or where the breach is severe.

Sections that by their nature should survive termination — health disclaimers, intellectual property, limitations of liability, indemnification, and governing law — remain in effect.

🏬 App Store Terms

These Terms are between you and MunchLog only — not with Apple or Google. The following applies where you obtained the App from the Apple App Store:

• Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, regulatory non-compliance, or consumer protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual property infringement claim relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

Google Play's own terms apply equivalently where you obtained the App from Google Play.

⚖️ Governing Law

These Terms are governed by the laws of the State of Israel, without regard to its conflict of law provisions. The competent courts of Tel Aviv-Yafo have exclusive jurisdiction over any dispute arising from these Terms or your use of the App.

If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law grants you the right to bring proceedings locally or to the protection of mandatory consumer rules, nothing here removes that right.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

🔄 Changes to These Terms

We may update these Terms to reflect changes in our practices, the law, or the App's features. We will notify you of material changes by displaying a notice in the App and updating the date at the top of this page.

Continued use after changes take effect constitutes acceptance. If you disagree with the new Terms, stop using MunchLog and delete your account.
