✅ Acceptance of Terms

By downloading, installing, or using the MunchLog mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MunchLog ("we," "us," or "our").

These Terms apply to all users of the App, regardless of how you access it (iOS App Store, Google Play Store, or otherwise). Please read them carefully before using the App.

If you are using MunchLog on behalf of an organization, you agree to these Terms on behalf of that organization.

📱 Description of Service

MunchLog is a nutrition and wellness tracking application that allows you to:

• Log meals by describing them in plain language or by photograph
• Receive AI-generated estimates of calorie and macronutrient content
• Track daily water intake
• Record and visualize weight trends over time
• Set and monitor personalized nutrition goals
• View meal history and weekly nutrition summaries

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time. We'll try to give you reasonable notice of significant changes.

🏥 Health & Medical Disclaimer

What MunchLog is NOT

• A substitute for professional medical advice, diagnosis, or treatment
• A clinically validated nutritional analysis tool
• A tool for managing eating disorders, diabetes, or other medical conditions requiring precise nutritional tracking
• A licensed healthcare provider

Important Limitations of AI Estimates

Our AI estimates calorie and macronutrient content based on your text descriptions and photos. These estimates:

• Are approximations and may differ from actual nutritional values
• Cannot account for individual preparation methods, exact portion sizes, or recipe variations
• May have higher error rates for uncommon foods, mixed dishes, or culturally specific cuisine
• Should not be used for medical nutrition therapy without verification by a professional

Always consult a qualified healthcare professional, registered dietitian, or nutritionist for medical nutrition advice, especially if you have a health condition, are pregnant, or are managing a specific diet for medical reasons.

👤 Your Account & Data

No Account Required

MunchLog does not require you to create an account or provide any personal information to use the App.

All Data is Stored Locally on Your Device

This means:

• Your health data stays on your phone at all times
• MunchLog has no access to your personal data and cannot retrieve it
• Deleting the app permanently and irreversibly erases all your data — we have no copy
• Data cannot be migrated to a new device through MunchLog — it does not leave your current device
• No backup, sync, or export functionality is provided; your device's own backup system (iCloud, Google Backup) may capture app data subject to your device settings

Your Responsibility

Because all data is local, you are solely responsible for:

• The accuracy of information you enter into the App
• Maintaining the security of your device and preventing unauthorized access
• Understanding that switching devices or deleting the App will result in permanent data loss

Data Loss

MunchLog is not responsible for data lost due to device damage, app deletion, factory resets, OS upgrades, or any other cause. Since we do not hold a copy of your data, we are unable to recover it under any circumstances.

🚦 Acceptable Use

You agree to use MunchLog only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable local, national, or international laws or regulations
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Use automated scripts, bots, or tools to access the App in a manner that could damage, disable, or impair our servers
• Attempt to gain unauthorized access to any systems or networks connected to the App
• Upload or transmit any viruses, malware, or other malicious code
• Use the App to transmit spam, unsolicited advertising, or promotional material
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the App for any commercial purpose without our prior written consent

The MunchLog name, logo, app design, user interface, graphics, features, and all other content are owned by or licensed to MunchLog and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of the content you create in MunchLog, including meal descriptions and photos you upload. By using the App, you grant us a limited license to process your content solely to provide the App's features to you — for example, sending your meal description to our AI service to generate a nutritional estimate.

Feedback

If you submit feedback, ideas, or suggestions about MunchLog, you grant us a perpetual, royalty-free license to use that feedback to improve our services without any obligation to you.

💳 Subscriptions & Purchases

Free and Premium Tiers

MunchLog offers a free tier with core features and an optional premium subscription ("MunchLog Premium") with additional features. Premium features are described within the App at the time of purchase.

Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store on a recurring basis (monthly or annual, as selected). Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then. We do not offer prorated refunds for unused subscription time.

Refunds

All purchases are processed by Apple or Google. Refund requests are handled by the respective platform in accordance with their policies. For iOS, submit refund requests through reportaproblem.apple.com.

Price Changes

We reserve the right to change subscription prices. We will notify you of any price changes in advance, and you will have the opportunity to cancel before the new price takes effect.

⚠️ Disclaimers & Limitations of Liability

App Provided "As Is"

MunchLog is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Accuracy of AI Estimates

We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of AI-generated nutritional estimates. Actual nutritional content may vary significantly from estimates provided by the App.

Limitation of Liability

To the fullest extent permitted by applicable law, MunchLog and its team shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or goodwill
• Health outcomes, weight changes, or dietary decisions based on App data
• Any damages arising from reliance on AI-generated nutritional estimates
• Service interruptions, bugs, errors, or App unavailability

In no event shall our total liability exceed the amount you paid for the App in the twelve months preceding the claim, or $50 USD, whichever is greater.

Indemnification

You agree to indemnify and hold harmless MunchLog from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

🚪 Termination

You may stop using MunchLog at any time by deleting the App from your device.

We reserve the right to restrict or terminate access to the App if we determine, in our sole discretion, that you have violated these Terms or engaged in conduct harmful to MunchLog, our users, or third parties.

Sections of these Terms that by their nature should survive termination (including health disclaimers, intellectual property rights, limitations of liability, and governing law) will remain in effect after termination.

⚖️ Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MunchLog operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App that cannot be resolved informally will be subject to binding arbitration, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

🔄 Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, legal requirements, or App features. We will notify you of material changes by:

• Displaying a notice within the App
• Updating the "last updated" date at the top of this page

Your continued use of MunchLog after changes become effective constitutes your acceptance of the revised Terms. If you disagree with the new Terms, you should stop using the App and delete it from your device.
